Service description
Mochi is an iOS application that transforms your photos into kawaii and anime-inspired artwork using artificial intelligence. The app uses multiple AI service providers to generate images.
Eligibility
You must be at least the minimum age required by applicable law to use Mochi, typically between 13 and 16 depending on jurisdiction. If you are under 18, you must have parental or guardian consent. By using the app, you confirm that you meet these requirements.
User identification
Mochi does not use traditional user accounts. A pseudonymous user ID is generated on your device and synced via iCloud Keychain. This ID is used to manage your Sparks balance, usage limits, and fraud prevention. You can view your user ID in the app under Settings > Privacy.
Sparks and payments
Sparks are the in-app currency used to generate images. Sparks are purchased through the App Store as consumable in-app purchases. Each image style has a specific Spark cost, which is clearly displayed before generation begins. Sparks are deducted when image generation starts. Sparks are sold in packages of varying sizes, and some packages may include bonus Sparks. Current prices and available packages are shown in the Spark Store within the app. Sparks do not expire and may be used at any time. All Spark purchases are non-refundable, and refund requests must be handled through Apple’s App Store support. Mochi does not offer subscriptions and uses pay-per-use pricing only.
Failed generations
If image generation fails due to a technical error on our side, Sparks are not deducted. If generation fails due to a content policy violation, Sparks may still be deducted depending on processing costs already incurred. We reserve the right to adjust Spark costs at any time.
Acceptable use
You agree not to use Mochi to upload illegal, explicit, pornographic, discriminatory, hateful, or infringing content; to attempt to bypass content filters; to use automated tools or bots; to resell or commercially redistribute generated images at scale; or to reverse engineer, exploit, or abuse the service.
Content filtering
Mochi includes on-device NSFW detection. Content that violates our policies may be rejected, and repeated violations may result in temporary or permanent suspension of access to the service.
Photo processing and responsibilities
You must own or have permission to use any photos you upload. You are responsible for ensuring that you have all necessary rights to the content you provide. Your photo is securely uploaded to our servers, temporarily processed by an AI service provider to generate artwork, returned to your device, and deleted from our servers within 24 hours. Generated images are stored only on your device and may be saved, shared, or exported by you.
Content ownership
You retain all rights to your original photos. You also retain all rights to AI-generated images created from your photos and may use them for personal or commercial purposes. The Mochi app, its branding, design, and code remain our property and may not be copied, modified, or redistributed. You grant Mochi a temporary, non-exclusive license to process your photos solely for the purpose of generating your artwork. This license ends once processing is complete and your photo is deleted.
Service availability
Mochi is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability, specific results or output quality, or compatibility with all devices. We may modify, suspend, or discontinue the service at any time without prior notice.
Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the greater of the amount you paid for Mochi services in the last 12 months or 50 USD. Nothing in these Terms limits or excludes liability where such limitation is not permitted under applicable law, including mandatory EU consumer protection laws.
Termination
You may stop using Mochi at any time by deleting the app. Unused Sparks are not refundable upon termination. We may suspend or terminate your access if you violate these Terms or repeatedly breach content policies. Termination does not entitle you to a refund of unused Sparks.
Changes to terms
We may update these Terms from time to time. Significant changes will be communicated through the app. Continued use of Mochi after changes take effect constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms are governed by the laws of the Czech Republic. For EU consumers, this does not affect your rights under mandatory consumer protection laws in your country of residence.
